You never want to be in the position of a case being dismissed, even for a document being out of place. There is a difference between a motion to dismiss, an order to dismiss, and a dismissal. If the case has not yet reached dismissal status, you can file (in most courts) a motion to reconsider dismissal. I would file the missing document on ECF and attach a copy to the motion. If it goes well, you won't even need to see the judge to get the motion to dismiss withdrawn.

It always helps to be current on payments. If you have any specific questions about a case, you can email me at jim@padebt911.com

What if you just inadvertently left out one form and didn't file it in time, hence violating the court order to do that but are current on the payments ? Are your chances better in this case? Thanks.

My problem with Debt Settlement companies isn't their marketing strategy, that works great, my problem is they sell a lousy product. There are very few clients who debt settlement works for and I am happy to handle a case like that if it does, but frankly Chapter 7 is usually more cost effective and solves more problems because banks are forced to comply with the court.

I agree. Debt Settlement companies are not the only one that does this type of emotional marketing. It appears if you go after someone's emotional state you can manipulate them faster.

It actually does make sense in a perverse way, because you can only file bankruptcy every so often, so if you've just recently filed bankruptcy and gotten a discharge, a creditor is more likely to lend to you because they know you can't get off the hook with Chapter 7 bankruptcy for another eight years.

Debt settlement companies teach the consumer to go so far past due on their debts that the creditor will take 40-50% of the balance in settlement. This usually requires going past due six months or more. Since you are treated as if you filed a Chapter 13 bankruptcy when a debt goes more than three months past due, I find it laughable that they settled your debt without hurting your credit, unless your credit was already shot. Bottom line, you can't have your cake and eat it too, and that's exactly what these companies are peddling to consumers, especially minorities.

I was on these blogs a few months ago trying to get help and reading articles such as these. But I don't think i'd be where I am today if it wasn't for dedt settlement. I’m a 49 year old man and I’m married with 2 kids so I have bills up to my neck every month…and on top of that I found myself unable to pay all those stupid credit cards I decided to open up when I was an immature and irresponsible college student. I didn’t want to mess up my credit score but I would avoid phone calls and I just hated living my life like that so I finally decided to do something about it. Debt relief is exactly that…RELIEF…I honestly feel so much better and it’s because of XXXXX Debt Settlement . I did my research and Googled the company and they are legit and helped me with my creditors…now my debts are significantly less and I can actually afford to make payments.

Jim,

I know what you mean! I haven't been unemployed for more than a few weeks myself, and I'm usually able to find something if I make it my focus. Sometimes I didn't always get the job I wanted, but I got something, and it took care of the bills.

I have plenty of clients that are unemployed right now, and I tell them all to do what you can to stand out. If ten people are applying to the same job you are, how can you be different and better than them?

Good stuff. I've been reading for the last few weeks, and I've learned a lot. Keep it up!

Thanks for the great article! I have spent over 16 years in financial services and you are right on track with this. Another point to ad is that most lenders would rather see a bankruptcy that numerous collection accounts that have been settled. It doesn't always make sense, but I have worked for numerous banks and mortgage companies that had guidelines that allowed for bankruptcies but not settled debts.

Thanks again for the great information!

Thanks for the education on this Jim. I didn't really know what the difference was, and I'm glad you made the clarification.

I'm going to go shoot this out on Twitter now. Take care and have an awesome day!
